INFORMATION ON THE PROTECTION OF PERSONAL DATA

The Registration Data as well as any other information that can be associated, directly or indirectly, with a specific User, are collected and used in compliance with Reg. (EU) 2016/679 -GDPR- and with the Italian legislation on the protection of personal data in force. Rikorda informs that:
a) The Registration Data are provided directly by the interested party (User) and are collected and used by Rikorda, also through IT tools and procedures;
b) The purposes pursued by the processing of data, for which the provision is mandatory, under penalty of the impossibility of providing the Service, are directly connected and instrumental to the provision and management of the Service itself, in compliance with these GENERAL CONDITIONS and include , by way of example, but not limited to, the acquisition of personal data, the acquisition and storage of photographic images and projects (also with third-party services in Cloud mode), the acquisition and fulfillment of orders, the electronic transaction of payment of the order, shipment of the prints to the agreed point of sale (independent data controller) indicated by the User for collection or directly to the user's address, sharing of images/projects to the subjects indicated by the user and possibly on social networks, the transmission of e-mails to third parties with the indication of the images/projects shared by the User, the diffusion of images/projects for which the User has authorized viewing even for unregistered subjects, the sending of information on the use, news and updated features of the Service to the User, by traditional mail or electronic mail; for authorized Users only: management of the point of sale, management of connected Users for collection of printouts, dissemination of the showcase page containing point of sale data, etc.
c) Additional purposes, for which the granting of consent to the processing is optional and can be expressed or denied by the User even after your registration to the Service, by changing the setting on the "My data" page, which can be reached by entering the username and password to the URL https://www.rikorda.it, consist of: (i) forwarding commercial, marketing and market research information, sending advertising material relating to Rikorda products and services or third party advertisers (including affiliated points of sale); (ii) detection of the quality of the Services and the degree of satisfaction of the Users, carried out both directly and with the collaboration of specialized companies; (iii) management of contests or prize operations; (iv) statistical surveys.
d) In consideration of the fact that rikorda.it is a product of the Rikorda Scarl Consortium, which brings together a series of photo laboratories (joint data controllers), the list of which can be consulted at the URL https://www.rikorda.it/fotolaboratori, for needs related to the centralized provision at group level of IT activities and/or instrumental to the management of the Service, some personal data may be stored on IT supports at other companies of the group or at third parties, for the same purposes
e) The provision of Registration Data is optional. However, failure to provide, even partially, the data expressly indicated as necessary for the pursuit of the purposes referred to in point b) above will make it impossible for Rikorda to proceed with the provision of the Service. Failure to provide data not expressly indicated as necessary for the purposes referred to in point c) above will not affect the provision of the Service in any way.
f) Some data, for all the purposes indicated above in point b), may be communicated by Rikorda to other companies of the Rikorda group or to third parties, entrusted with the execution of activities directly connected and instrumental to the provision and distribution of the Service. as well as, subject to the User's consent, to third-party companies that offer goods and/or services, including on the Internet, for the purposes indicated above in point c), or with which Rikorda has stipulated commercial or partnership agreements aimed at promoting diffusion and distribution of the Service or the offer of new services.
g) On the occasion of particular events or demonstrations, such as competitions or prize operations, some personal data of the User who has adhered to the aforementioned events may be disclosed by publication on the rikorda.it website.
h) For organizational needs related to the provision of IT and/or instrumental activities for the management of the Service, some personal data of Users may be made available abroad, in countries belonging to the European Union (EU) or to the European Economic Area ( IF IT'S). Should personal data be made available outside the EU or EEA, the Data Controller guarantees that in the absence of an adequacy decision by the Commission it will adopt adequate guarantees for the fundamental rights and freedoms of the data subjects. Recipients of the communications and transfers will be the companies (which carry out the processing as independent data controllers or as data processors) which Rikorda uses to provide the Service and which will use such data for the same purposes for which Rikorda collected such data or in cases and subjects established by law. The data will not be disclosed unless otherwise provided by law or subject to anonymisation.
i) At any time, the interested party may: exercise his rights (access, rectification, cancellation, limitation, portability, opposition, absence of automated decision-making processes) when provided for with respect to the data controller, pursuant to articles from 15 to 22 of the GDPR - Reg. (EU) 2016/679; propose a complaint to the Guarantor (www.garanteprivacy.it); and if the treatment is based on consent, revoke this consent given, taking into account that the revocation of consent does not affect the lawfulness of the treatment based on the consent before the revocation.

j) Personal data will be kept, in general, as long as the purposes of the processing persist according to the category of data processed. Inactive projects are stored up to a maximum of 6 months; the photos sent for printing are kept for up to a maximum of 60 days from the sending of the order, in order to manage any returns/reprints.
k) The data controller is Rikorda SC.ARL, Via Santuario n.3, Boves (CN). The Data Protection Officer is: SPAZIOTTANTOTTO SRL, in the person of Eng. Massimiliano Bonsignori. Registered office in Via Nino Bixio, 8 – Turin (TO) E-mail: dpo@spazio88.com.
